Halle Berry and Olivier Martinez received two major rulings in their ongoing custody dispute involving their 13-year-old son, Maceo. A temporary domestic violence restraining order was dissolved, while Martinez retained primary physical custody at this time, as reported by Just Jared.

The latest developments emerged from the continuing legal case between Berry and Martinez over custody of their son. The dispute had previously resulted in Martinez receiving temporary primary physical custody alongside a temporary restraining order.

Martinez obtained that temporary restraining order after accusing Berry of physically abusing Maceo. Berry has denied the allegations made against her throughout the dispute.

Berry’s attorney previously rejected the accusations and described them as “entirely meritless and deliberately misleading.” The dissolution of the restraining order represented a significant favorable decision for Berry in the latest proceedings.

According to TMZ, the “domestic violence restraining order was dissolved.” Berry’s attorney, Marina Beck, publicly welcomed that decision and addressed how her client planned to proceed.

“We are extremely pleased that the Court has dissolved the TRO [Temporary Restraining Order],” Beck told Page Six. She also emphasized Berry’s focus on her family following the court’s decision.

“As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family,” Beck said. Her statement did not change the separate physical custody ruling involving Maceo.

Patrick Baghdaserians, Martinez’s lawyer, addressed Berry’s reported effort to change the existing custody arrangement. He apparently told TMZ that “Halle’s lawyers had asked to restore 50/50 custody, but the judge rejected that.”

Martinez had already received temporary primary physical custody before the October 2026 hearing. That custody arrangement had been issued alongside the temporary restraining order that the court has now dissolved.

TMZ reported that Martinez currently has primary physical custody of Maceo. Baghdaserians characterized the result as a “huge victory” for his client.

Los Angeles Superior Court Judge Shelley L. Kaufman also placed a restriction on Berry’s time with her son. According to NBC Los Angeles, Berry cannot have overnight visits at this time.

The physical custody ruling does not mean Berry has lost every form of custody. Her representative told TMZ that Berry still has joint legal custody despite Martinez retaining primary physical custody.

Berry’s representative also said she holds the tiebreaker if she and Martinez are “at loggerheads.” That reported authority remains part of the current arrangement as the dispute continues.

The court’s decisions produced different outcomes for the former couple. Berry secured the dissolution of the temporary restraining order, while Martinez kept the primary physical custody arrangement that was already in place.

The custody situation may soon receive further consideration. TMZ reported that the judge will reconsider custody issues in November, meaning those questions are expected to return to the court shortly.

For now, Martinez remains Maceo’s primary physical custodian, and Berry cannot have overnight visits. At the same time, Berry reportedly maintains joint legal custody and the stated tiebreaking authority described by her representative.

The competing statements from the lawyers reflected those divided results. Berry’s attorney celebrated the restraining order’s dissolution, while Martinez’s lawyer pointed to the rejected request for 50/50 custody and called the custody outcome a major victory.
