Halle Berry’s daughter Nahla Aubry has entered the custody dispute surrounding her mother and Olivier Martinez with a rare declaration defending the actress. In the Los Angeles Superior Court filing obtained by Page Six, Nahla described Berry as a “loving and devoted parent.”

Nahla, 18, said she has never witnessed Berry physically abuse her younger brother, Maceo Martinez, 13. “I have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way.”

She also directly addressed the conduct alleged against Berry. “I have never seen my mom place her hands around Maceo’s neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her.”

Nahla said she has lived with Maceo for most of his life. Before recently moving from California to Massachusetts for college, she divided her time between Berry’s home and the residence of her father, Gabriel Aubry.

In her declaration, Nahla portrayed Berry, 60, as an involved mother who consistently prioritized her children.

She said Berry “always made time for me and prioritized what was important to me,” and added that she watched her mother provide the same attention to Maceo.

“She attended his games, drove him to practices and tournaments, and advocated for his education,” Nahla stated. “She celebrates our successes, supports us through challenges and is always there when we need her.”

Nahla acknowledged that Berry could be strict and expected her children to respect rules. At the same time, she described her mother as warm, supportive, and deeply involved in their lives, stating, “I never observed anything abusive about her parenting.”

The college student said she was “shocked, very sad and very upset” after learning about Martinez’s allegations. She also said she was “heartbroken” for Maceo, whom she described as “funny, smart and full of personality.”

Nahla disputed another allegation from Martinez by saying she had never heard Berry make “racially insensitive or racially charged comments.” She pointed to the family’s background while describing what Berry taught both children.

“My mom is biracial, I am biracial, and Maceo is biracial,” Nahla wrote. “Throughout my life, my mom taught both of us to embrace who we are, appreciate our differences and respect people from all backgrounds.”

Nahla said she last spoke with Maceo on Sept. 29 while Berry was driving him to school. During their speakerphone conversation about Nahla’s college experience, she said Maceo “sounded happy for me and didn’t seem upset about anything.”

“I want very much to speak with my brother and check on him. I want him to know that I love him,” Nahla stated. She said she had refrained from contacting him because she was uncertain what Martinez’s court filings permitted.

Her declaration followed a restraining order request in which Martinez, 60, accused Berry of choking Maceo during an alleged Sept. 26 altercation at her home.

Martinez claimed an argument began while Maceo was playing a virtual reality game and that Berry grabbed their son by the neck and choked him.

Martinez also alleged that Berry had physically wrestled with Maceo on previous occasions and made racially charged remarks to him.

He subsequently sought sole custody, and a judge temporarily granted him primary custody while limiting Berry to court-ordered visitation for two days each week and every other weekend until an Oct. 16 hearing.

Berry has vehemently denied the allegations through her attorney, Marina Beck. In her response to Martinez’s filing, the actress asked the court to restore their 50/50 custody agreement.

Berry claimed Martinez causes Maceo to become “angry and combative” toward her because of his “continued attempts to align Maceo with him and against me in many areas of our child’s life and activities.”

Berry was seen with her son in Los Angeles days after the restraining order filing.

Berry and Martinez married in 2013 and separated in 2016. The court dispute now includes Nahla’s declaration describing Berry’s parenting and denying that she ever witnessed the alleged abuse or racially charged conduct.
